These terms and conditions apply to all orders placed by consumers via the online shop smartville.shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.<\/p>\n\n\n\n

\u00a7 3 Conclusion of contract<\/h2>\n\n\n\n

The presentation of products in the shop is not a legally binding offer but an invitation to order.<\/p>\n\n\n\n

You can add products to the basket and change or remove them at any time. At checkout, you enter your details, choose shipping and payment methods and check all information. By clicking the button \u201cZahlungspflichtig bestellen\u201d (order with obligation to pay), you make a binding offer to buy the goods in the basket.<\/p>\n\n\n\n

Immediately afterwards you receive an automatic email confirming receipt of your order. This confirmation of receipt is not yet an acceptance. The contract is concluded when we confirm your order by email or ship the goods.<\/p>\n\n\n\n

We store the contract text. You receive the order details and these terms by email. You can view the terms on this page at any time.<\/p>\n\n\n\n

All prices are final prices in euros. As per \u00a7 19 UStG, no VAT is charged.<\/p>\n\n\n\n

\u00a7 5 Shipping costs and delivery<\/h2>\n\n\n\n

We deliver within Germany only. Standard shipping is free (delivery time 5\u20138 working days). Express shipping costs \u20ac4.99 (delivery time 3\u20135 working days). Delivery time starts on receipt of payment and includes 1\u20132 working days of processing. You can find details under Shipping & delivery<\/a>.<\/p>\n\n\n\n

\u00a7 6 Payment<\/h2>\n\n\n\n

The available payment methods are shown at checkout and described under Payment methods<\/a> . For prepayment, we ship after receipt of payment.<\/p>\n\n\n\n

\u00a7 7 Retention of title<\/h2>\n\n\n\n

The goods remain our property until paid for in full.<\/p>\n\n\n\n

\u00a7 8 Right of withdrawal<\/h2>\n\n\n\n

As a consumer you have a statutory right of withdrawal. The details are in the Withdrawal policy<\/a>. You can also declare your withdrawal online via Withdraw from contract<\/a> .<\/p>\n\n\n\n

\u00a7 9 Warranty<\/h2>\n\n\n\n

Statutory liability for defects applies. The limitation period for claims for defects is 2 years from delivery of the goods.<\/p>\n\n\n\n

\u00a7 10 Liability<\/h2>\n\n\n\n

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.<\/p>\n\n\n\n

\u00a7 11 Dispute resolution<\/h2>\n\n\n\n

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.<\/p>\n\n\n\n

\u00a7 12 Contract language and final provisions<\/h2>\n\n\n\n

The contract language is German. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.<\/p>\n\n\n\n
